At OhyaInvestment ("Ohya," "we," "us," or "our"), we aim to put your money in the right spot with industry-leading returns. This Payment Policy outlines the terms governing payments, investments, withdrawals, and related processes for Users participating in our fractional investment opportunities. By using our website (www.ohyainvestment.com), mobile application, or related services (collectively, the "Platform"), you agree to abide by this Payment Policy, in addition to our Terms and Conditions and Privacy Policy. Please read this carefully before investing.
1. Overview of OhyaInvestment
1.1
OhyaInvestment enables Users to make fractional investments in company-owned properties, lands, or physical spaces ("Properties"). Investors do not acquire any right, title, or interest in these Properties.
1.2
Investments are made in virtual or partial units (e.g., square yards) of Properties, with annual returns ranging from 18-24%, credited solely to your registered bank account, based on the duration of your investment.
1.3
All Properties are owned and managed by OhyaInvestment, ensuring a secure and streamlined investment process.
2. Investment Process
2.1 Eligibility - To invest, you must
Register on the Platform with a User Login.
Complete Know Your Customer (KYC) verification by submitting government-issued ID (e.g., PAN, Aadhaar, Passport), proof of address, and bank details.
2.2 Browsing and Selection
Log in to view our curated list of company-owned Properties, including project details, available virtual units (ranging from 1 to 100 square yards), and expected returns.
2.3 Payment
Investments start at a minimum of ₹10,000, with no upper limit, subject to availability.
Payments must be made in Indian Rupees (INR) via approved methods (e.g., bank transfer, UPI, net banking) through the payment link provided in your User Login or by a Sales Manager.
Upon payment, you will receive a digitally signed PDF agreement detailing legal terms, accessible in your User Login portal and mailed as a physical copy to your registered address.
2.4 Confirmation
Transactions are confirmed once funds are received and KYC is verified. Investments are then locked in as per Section 3 below.
3. Lock-In Period and Returns
3.1 Lock-In Period
All investments are subject to a minimum lock-in period of 6 months from the date of investment confirmation.
3.2 Returns Structure
Less than 6 Months - If you withdraw before 6 months, you receive 0% return, plus a pre-closure charge (see Section 4).
6 to 12 Months - Withdrawals between 6 and 12 months yield a 7.5% annualized return, subject to pre-closure charges.
12 Months and Beyond - After 12 months, you are entitled to an 18% annualized return, credited annually. If you do not withdraw, the investment continues with the same 18% return each year.
Over 2 Years - Investments held for more than 2 years earn a fixed 24% annualized return, credited annually.
3.3 Annual Distribution
Returns are calculated and credited to your registered bank account once per year, net of applicable fees, taxes, and deductions.
4. Withdrawals
4.1 Withdrawal Request
You may request a withdrawal at any time via your User Login portal, subject to the lock-in period and liquidity availability.
Funds will be credited to your registered bank account within 4-5 business days of approval, provided KYC and bank details are complete and verified.
4.2 Pre-Closure Charges
Withdrawals before 6 months incur a pre-closure charge of 5% of the invested amount.
Withdrawals between 6 and 12 months incur a pre-closure charge of 3% of the invested amount.
No pre-closure charges apply after 12 months.
4.3 Delays
Ohya reserves the right to delay withdrawals in exceptional circumstances (e.g., legal disputes, banking issues, or force majeure), with notice provided via email or the Platform.
4.4 No Property Sale
Withdrawals do not involve the sale of Properties, as all assets remain company-owned. Your investment is a financial contribution, not an ownership stake.
5. Fees and Deductions
5.1 Platform Fee
A one-time fee of 2% of your investment, deducted at the time of investment, for facilitating the opportunity.
5.2 Management Fee
An annual fee of 1% of your investment, deducted from returns, for Property management and operations.
5.3 Pre-Closure Charge
As outlined in Section 4.2, applied to early withdrawals.
5.4 Taxes
Applicable taxes (e.g., TDS) will be deducted from returns as per Indian tax laws and credited to the government on your behalf.
5.5
All fees and charges will be disclosed prior to investment confirmation.
6. Refunds and Cancellations
6.1
Investments are non-refundable once confirmed, except in cases of technical errors (e.g., duplicate payments), where refunds will be processed within 10 business days after verification.
6.2
Cancellations are not permitted post-investment confirmation, as funds are allocated to company-owned Properties.
7. Payment Security
7.1
All transactions are processed through secure, RBI-compliant payment gateways.
7.2
Ohya is not liable for losses due to User errors (e.g., incorrect bank details) or third-party payment provider failures.
8. Risks and Acknowledgments
8.1
Investments are subject to risks, including potential delays in returns or withdrawals due to market conditions or operational challenges.
8.2
Returns are not guaranteed and depend on the performance of company-owned Properties.
8.3
You acknowledge that pre-closure may result in reduced or no returns, as outlined in Section 3.
9. Amendments
9.1
Ohya reserves the right to modify this Payment Policy at any time. Changes will be posted on the Platform and emailed to registered Users at least 15 days before taking effect.
9.2
Continued use of the Platform after amendments constitutes acceptance of the revised Policy.
